PROFESSOR TERRY CO-MODERATES PROACTIVE MANAGEMENT BASED REGULATION (PMBR) SESSION FOR LEGAL REGULATORS DURING THE NOBC AND ABA MIDYEAR MEETINGS

Laurel S. TerryFebruary 2020 — Professor Laurel S. Terry recently co-moderated a Roundtable for National Organization of Bar Counsel (NOBC) members on the topic of proactive regulation. Lawyer regulators from around the country were invited to attend the February 14, 2020 session, which was held in Austin, Texas during the NOBC and ABA Midyear Meetings.

During the Roundtable, Professor Terry distributed a Resources document she had prepared, her scholarship on this topic, and several PMBR “one-pagers” she created from the relevant ABA, Colorado, Illinois, and Nova Scotia regulator webpages. These items, along with the February 2020 Roundtable agenda, are available on her website.

Professor Terry is one of a handful of scholars who has written about proactive lawyer regulation. Her scholarship includes a 2016 Jotwell essay entitled When It Comes to Lawyers… Is an Ounce of Prevention Worth a Pound of Cure? and a 2016 law review article entitled The Power of Lawyer Regulators to Increase Client & Public Protection Through Adoption of a Proactive Regulation System. Her scholarship has reviewed PMBR initiatives in Australia, Canada, and the United States, and has argued that U.S. lawyer regulators should develop a systemic approach to preventing lawyer problems. Several state Supreme Courts, including Illinois and Colorado, have endorsed PMBR. In August 2019, the American Bar Association adopted Resolution 107, which encourages all state Supreme Courts to consider proactive regulation. Professor Laurel Terry, who holds the H. Laddie Montague, Jr. Chair in Law, is a three-time Fulbright recipient who writes and teaches about the impact of globalization on the legal profession, especially with respect to regulatory issues. Her scholarship has identified emerging issues for the legal profession and urged stakeholder engagement, new initiatives, and regulatory reform. In addition to speaking at academic and professional conferences, she has been invited to speak about her scholarship to has been invited to speak about her scholarship to organizations that include the Conference of Chief Justices, the National Conference of Bar Examiners, the National Organization of Bar Counsel, the National Conference of Bar Presidents, the CCBE, which represents EU’s legal profession and legal regulators, the Federation of Law Societies of Canada, the International Institute of Law Association Chief Executives, the International Bar Association, and the International Conference of Legal Regulators.
