CARLISLE, Pa.—Professor Stanley Brand, Distinguished Fellow in Law and Government at Penn State Dickinson Law, was interviewed on Dan Abrams’s Sirius radio program on December 8, 2025, about the Supreme Court oral argument in Trump v. Slaughter, the case challenging the firing of a Federal Trade Commission commissioner.
The case represents a major separation of powers case over the president’s power to remove independent agency heads that Congress has provided may only be terminated for cause. The administration is trying to overturn a 1935 Supreme Court case involving the FTC that protected a commissioner from removal.
