As the Department of Homeland Security (DHS) began acquiring warehouses for Immigration and Customs Enforcement (ICE) detention facilities, plaintiffs alleging the move necessitated environmental assessments or impact statements under the National Environmental Policy Act shifted into gear. A recent injunction in one of the cases has changed the DHS playbook.
Colburn has written extensively on the National Environmental Policy Act (NEPA) and studied the patterns of relief granted by courts in cases where the act has been violated. This latest front in NEPA litigation comes on the heels of a bipartisan overhaul of the statute in 2023.
Jamison E. Colburn is the A. Robert Noll Distinguished Professor of Law and a leading scholar of environmental and natural resources law. He has published extensively on the law of environmental assessment, the protection of habitat and at-risk species, and the jurisdiction of water disputes. His work routinely considers the legal system’s dependence on science and scientific information. His latest book, The Mind of Janus, chronicles a century of law and science intersections in the governance of our national forests. Prior to teaching, he served as Assistant Regional Counsel at the U.S. Environmental Protection Agency and as Trustee of the Connecticut River Watershed Council.
